How to Apply for LTC Exemptions

Dear Members,

As new information has been provided by the state, we want to keep you informed when it comes to the new WA Cares Fund and how you may be eligible to opt-out.

Opting Out

For those that are interested in opting out of the WA Cares coverage, the state has provided information on the WA Cares Fund Website about exemptions, eligibility, and how to opt out. Keep in mind, information may be subject to change at the state’s discretion. We highly recommend frequently checking their website for any changes or updates.

Who is eligible?

To apply for a permanent exemption, you must: 

  • Have purchased a qualifying private long-term care insurance plan before Nov. 1, 2021. 
  • Be at least 18 years of age. 
  • Submit an exemption application to the Employment Security Department (ESD). Exemption applications became available on Oct. 1, 2021. ESD can only accept exemption applications through Dec. 31, 2022.

Where do I apply?

To apply for a WA Cares Fund exemption, visit the Apply for an Exemption page and follow the instructions listed there (instruction steps also attached here for easy reference). Once you have applied, the Employee Security Department (ESD) will review your application and notify you if you’re eligible for an exemption from WA Cares coverage.

After Enrollment:

  1. If your application is approved, you are permanently expelled from the program with no option to re-enroll.
  2. You will be disqualified from accessing WA Cares Fund benefits in your lifetime.
  3. You will be required to present your exemption approval letter to all current and future employers. If you fail to present your ESD approval letter, employers will withhold non-refundable WA Cares premiums.
  4. Exemptions will take effect the quarter after your application is approved. The State has not yet provided details on how long it will take the approval process to be completed and you will continue to pay the tax until these steps are completed.

Important Reminders:

  • Although you don’t need to upload your policy during the current application process, make sure you save it in a safe place, because you may need to provide it to the state in the future.
  • Remember to also save your approval letter after providing it to your current employer, since you’ll need to continue to provide this document to any future employers to avoid paying this tax.

We are aware that users have come across issues with the WA Cares Fund Website while attempting to apply for exemption. Note that it may take multiple attempts to complete the application.
